The Central Securities Depository SA was established in accordance with Article 33a of Law 1806/1988 of 22.2.1991 (Government Gazette Issue 434/22.2.1991) as a societe anonyme for clearing and settling securities transactions, a task previously handled by an Athens Exchange Department. In 2006, CSD SA was absorbed by the parent company of the Hellenic Exchanges Group under the name HELLENIC EXCHANGES SA Holding, Clearing, Settlement and Registration (HELEX). In 2010 the clearing function was segregated and assigned to ATHEX Clear.
HELEX is the administrator of the Dematerialized Securities System (DSS) operating in accordance with the Codified Regulation on the Operation of the Dematerialized Securities System (DSS Regulation) issued by the Hellenic Capital Market Commission and acts as the Central Securities Depository (CSD) under authorization granted by Laws 3606/2007 and 3756/2009.
The CSD provides Operators with services pertaining to transaction settlement, securities registration, corporate actions, tax support for domestic and foreign securities and investor services through DSS.
The CSD is a member of the ECSDA (European Central Securities Depositories Association).
The CSD responds to several questionnaires from regulators such as ESMA and ECB and institutional investors/global custodians on its various areas of operation each year. In this context and upon agreement between the Members of ECSDA and the Association of Global Custodians, it publishes its response to the relevant AGC questionnaire section of the website.
Under the provisions of Law 2396/1996, entries in the CSD are confidential and the relevant historical records and documents are maintained for six years.
Being a critical system for the operation of the capital market and in order to ensure the uninterrupted operation and safety of DSS data, CSD has built a Disaster Recovery Center and has compiled a Business Continuity Plan. The CSD regularly tests the smooth transition of its operations between the central facilities and the recovery center and it performs full simulation tests with the participation of Operators at least once per year.
The CSD complies with the provisions of Law 2472/97 on personal data protection.
